The Apple v Samsung patents row rumbles on as US judge cuts damages award to Apple

The seemingly never ending patents row legal battle between Apple and Samsung is entering yet another stage.

Here is the story so far…Apple accused Samsung of infringing a number of its smartphone patents and won.

A jury awarded $1.05bn damages in August but Samsung appealed, saying that the award was excessive.

Judge Lucy Koh ruled yesterday (fri) that the award was too high and reduced it by $450m.

However she has also ordered a new jury trial to determine how much damages, if any, should be awarded to Apple for a series of other infringements not covered by the original jury award.

Judge Koh had urged Samsung and Apple to try and negotiate a settlement with which both would be happy in order to avoid tasking another jury with having to make a decision on the matter.

As of now they have not been able to do so but independent patents analyst Florian Müller says they may yet do so before the matter is actually put before a jury.

He said: “The second damages trial is unlikely to take place, because in the meantime there will be appeals of what’s [already] been decided so far, and at some point there will be a settlement.
